Control Yuan corrects EY, NCC and DOH for failing to stop counterfeit drugs (2010/07/08)

Taiwan market overflows with counterfeit drugs, inferior drugs and illegal drugs. According to the Control Yuan’s investigation, the quantity of illegal drugs available in the Taiwan market is six times more that that in developed countries. Considering the slow reaction to the problems, insufficient investment in drug management and lenient punishment for offenders, the Control Yuan orders the EY, DOH and NCC to take corrective measures.
Wu Feng-Shan, Teresa Yin and Chien Lin Whei-Jun, members of the Control Yuan, launched an investigation and revealed that the market share of counterfeit/ inferior/ illegal drugs is between 6% and 24% in Taiwan, which is about 6 times higher than in developed countries. Despite the worsening situation, the sources allocated to drug management are clearly inadequate. Wu Feng-Shan said “We are far behind many advanced countries in the investment of drug management.”
Control Yuan members expressed that the punishment given to offenders of counterfeit/ inferior/ illegal drugs are too lenient to commensurate with the profits from the crime and the damage to the health of the nation. There is no sense of justice. Chien Lin Whei-Jun said “People manufacturing, importing or selling illegal drugs are subject to a sentence of imprisonment for at most 10 years and millions of fine, but it never really happens. Therefore, the CY considers that the justice authorities have failed the society’s expectation.”
The members of the CY also criticized the promotion activities and placement marketing of illegal drugs on broadcasting programs. They also criticized the DOH for a lengthy reporting and investigation process, which could take months. The CY orders the EY, DOH and NCC to make improvement within a specified deadline, and requests the justice authority to review the punishment for illegal drugs.
