Pharmaceutical companies mandated to report trade agreement to competent authority

To prevent brand name drug companies’ trade deals from hindering the market access of generic drugs and making it impossible for patients to quickly access low-priced drugs, Taiwan Food and Drug Administration (TFDA) gave a notice on the draft of “Regulations for the Notification of Drug Patent Linkage” today. The regulations require that any settlement agreement between any brand name drug patentee and any generic drug patentee must be reported to the central competent health authority within 20 days after the occurrence of such matter. Patentees may face a fine up to NT$2 million if they do not make such report.
